Lack of professional recognition in Spain and its effect on the insurance coverage in the school liability insurance

SüdwestRing was able to decisively extend the insurance coverage in the business and professional liability for all water sports schools in Spain.


Insurance contracts have "hooks and eyes" which are also called exclusions or limitations of insurance coverage. SüdwestRing was able to decisively extend the insurance coverage in the business and professional liability for all water sports schools in Spain.

If water sports instructors do not have the legally required professional recognition, the liability insurance can simply refuse in the event of a claim and does not have to pay. The reason is a passage in the insurance conditions that states that the policyholder must comply with all laws and regulations, otherwise the insurer will not pay.

The SüdwestRing framework contract for the business liability insurance of VDWS schools has now been supplemented by the insurer with a general declaration stating that the insurer will not apply this negative contract passage in the event of a claim if the instructor responsible does not have the legally required training in Spain. However, the prerequisite for this is that the involved instructor/owner has a completed training as a kite, windsurf or sailing instructor of another European training association for his activity. Through this new agreement, not only the VDWS professional training, but also that of all other associations, such as IKO, FFEV, FIV, FF Voile Federatión, FFVL, FKSU will be recognized by SüdwestRing or its risk carrier.

This agreement is automatically valid for all school and professional liability insurances in Spain that exist through SüdwestRing.
